Textraction Terms of Use

Introduction

These Terms of Use (the “Agreement”) govern the use of the Textraction service (the “Service”) by the user (the “User”), including the API and website. By accessing or using the Service, the User agrees to be bound by this Agreement.

Use of Textraction

Textraction provides the User with the ability to extract entities from free text using an AI model. The User acknowledges that the output of Textraction may contain statistical errors and is not guaranteed to be accurate nor match the user's expected values. The service may be subject to limited availability, errors, or other issues. Textraction may use third-party services to process and store user input and output.

Prohibited Usage

We prohibit the use of our services for illegal activities, including:

• Generation of malware that attempts to disrupt, damage, or gain unauthorized access to a computer system.
• Activity that has a high risk of physical harm, such as weapons development, military and warfare, management or operation of critical infrastructure in energy, transportation, and water.
• Content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders.
• Activity that has high risk of economic harm, including multi-level marketing, gambling, payday lending, automated determinations of eligibility for credit, employment, educational institutions, or public assistance services.
• Fraudulent or deceptive activity, including scams, coordinated inauthentic behavior, plagiarism, academic dishonesty, astroturfing, disinformation, spam, and pseudo-pharmaceuticals.
• Political campaigning or lobbying that involves generating high volumes of campaign materials, building conversational or interactive systems such as chatbots, or building products for political campaigning or lobbying purposes.
• Activity that violates people's privacy, such as tracking or monitoring an individual without their consent, facial recognition of private individuals, classifying individuals based on protected characteristics, or using biometrics for identification or assessment.
• Engaging in the unauthorized practice of law or offering tailored legal advice without a qualified person reviewing the information.
• Offering tailored financial advice without a qualified person reviewing the information.
• Providing medical information, such as telling someone that they have or do not have a certain health condition, or providing instructions on how to cure or treat a health condition.
• High risk government decision-making, including law enforcement and criminal justice, migration, and asylum.

RapidAPI Access

The Textraction API service is available on the RapidAPI platform, which provides access to the Service through its website and API. The User agrees to comply with RapidAPI's terms of use and other agreements related to the use of the RapidAPI platform. Textraction is not responsible for any issues concerning RapidAPI access to the Textraction service, including but not limited to user management, billing, or disputes between the User and RapidAPI. Any such issues should be resolved directly with RapidAPI.

Privacy Policy

By using Textraction, the User agrees to the Textraction Privacy Policy, which is incorporated into this Agreement by reference. The Privacy Policy can be found at the Textraction website: https://www.textraction.ai

Intellectual Property

Textraction and all content and materials on the Website are the property of Textraction or its licensors and are protected by copyright, trademark, and other intellectual property laws. The User may not use any content or materials on the Website without the prior written consent of Textraction.

Disclaimer of Warranties

TEXTRACTION AND ITS SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TEXTRACTION DOES NOT WARRANT THAT ITS SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THEY WILL MEET THE USER'S REQUIREMENTS.

Limitation of Liability

TEXTRACTION SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE USE OF TEXTRACTION, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

The User agrees to indemnify and hold harmless Textraction, its officers, directors, employees, and agents, from any claims, damages, expenses, or other losses arising out of or related to the User's use of Textraction or any violation of this Agreement by the User.

Termination

Textraction may terminate this Agreement and the User's access to the Website, API and other services at any time, with or without cause.

Changes to this Agreement

Textraction may revise this Agreement at any time without prior notice. By continuing to access or use Textraction after such revisions become effective, the User agrees to be bound by the revised Agreement.
